The Ministry of Human Resource Development (MHRD) of the Government of India, in response to a Lok Sabha question recently asserted that educational institutions cannot demand capitation fees from students for admissions anymore. Smriti Irani, the Minister of MHRD after taking note of the very high capitation fees that are charged by various government and private educational institutes, has directed parents, students and the general public to refrain from paying any additional fee other than the amount mentioned in the Prospectus of the institution.
Instances of an excessive fee being charged by educational institutions first came to the notice of the All India Council of Technical Education (AICTE). As a result of the hefty donations that were demanded of students, the seats in a number of government and private institutes were found to be vacant. The council has, therefore, tightened admission norms and clearly underlined that educational institutes are not legally permitted to impose any additional fee other than the development and tuition fee.
Despite the orders that have been issued, if any institution continues to impose additional capitation fees, the institute shall be liable for punitive action and the approval of the institution could be withdrawn. Parents and students who are aggrieved can also approach the Grievance Redressal Committee of the Institution if any capitation fee is demanded of them. If students are not satisfied with the decision of the Grievance Redressal Committee, they can further appeal to the Ombudsman.
